PROJECT DESCRIPTION
At the
request of MIIT, IFC assisted with the preparation of the draft of the new SEZ
Law in 2024, based on international best practices and in consideration of
Uzbekistan's national legislation. This law introduces SEZs, which are to be
built and operated by private operators, in addition to the existing
state-owned SEZs. To support the implementation of the new law, MIIT, with IFC
support, will draft the Implementing Regulation for the SEZ law. Once the new
draft SEZ law is submitted to the
Ministry of Justice, the drafting of the Implementing Regulation will
begin. MIIT is the key counterpart from the Government of Uzbekistan,
coordinating these activities with an interministerial Working Group.
OBJECTIVE
OF THE ASSIGNMENT
The objective
of this assignment is to review the draft SEZ law and prepare a draft
Implementing Regulation.
SCOPE OF
WORK:
The
consultant will complete the following tasks:
Review of
the Draft SEZ Law:
- Conduct a desk review of the
draft SEZ law provided by MIIT and provide comments on any gaps or
misalignments with the key principles applied in countries that have
successfully implemented SEZs built and operated by private operators, as
well as SEZs managed by the state. The consultant is expected to review
the chapters on tax and customs regimes and provide comments based on
Uzbekistan's tax and customs legislation.
- Present the comments to MIIT and
IFC and engage in discussions on the findings.
Preparation
of a Draft Implementing Regulation:
- Prepare an outline of a draft Implementing
Regulation (draft Presidential Decree) to the SEZ law based on the draft
SEZ law and best practices from other countries with successful SEZs.
- Present and discuss the outline
with MIIT and IFC.
- Prepare a draft Implementing
Regulation to the draft SEZ law based on the outline approved by MIIT and
IFC and address comments on the draft Implementing Regulation received
from MIIT and IFC.
- Prepare a presentation on the
draft Implementing Regulation to the draft SEZ law and present it at a
stakeholder workshop organized by MIIT and IFC, and moderate the
discussion if necessary.
- Prepare an explanatory note,
regulatory impact assessment and all supporting documents required by the
legislation and Ministry of Justice to the draft Implementing Regulation for
review by the state bodies.
- Support the MIIT in the public
discussion of the draft Implementing Regulation with ministries, state
agencies, and the private sector, and address comments received.
